Planning Board Meeting Minutes
December 7, 2010
1. Call to Order: The regular meeting was called to order at 7:02 PM.

2. Attendance:  Members present were, Chair – Stan Brett, Vice Chair - Dan Peaco, Recording Secretary -Karen Turino, Herb Olsen &  Alternate - Rick Jackson (Absent - Dave McVety & Beth Damon)  

Code Enforcement Officer: Richard St. John

3. Quorum: Board had a quorum.  

4. Secretary’s Report:
A. Regular Meeting Minutes from November 16, 2010 *Motion to accept minutes. DP/KT –Unanimous.  
B. Site Walk Minutes from November 18, 2010 *Motion to accept minutes. DP/HO –Unanimous.

5. Discussion & Comments from public:
A. None.  

6. Residence - Based Business Applications:
A. None.  

7. Shoreland Zoning Applications:
A. Richard Negus, represented by Rick Dunton, Main-Land Development Consultants, Inc. Map U-08 Lot 004. Construction of a new cottage on a lot of record within 100' setback of Thompson Lake. The lot is small; approximately 150 feet long by 100 feet wide and has shore frontage on Thompson Lake. The property was granted w/ an easement along the North Camp Road and an easement on a nearby lot for subsurface wastewater disposal. The applicant is requesting a permit to build a 24’ x 36’ one story camp w/ full foundation on lot 2(4). As part of this plan he intends to install a septic tank near the camp and pump effluent to a small Elgen disposal field within the pre-determined subsurface wastewater disposal easement. Intent is for seasonal use. A Site Walk was held Thursday, November 18, 2010 @ 10:00 AM. Applicant & representative did not show. Setback variance was approved by BOA on 7/29/10.

Conditions of approval of setback variance by the Board of Appeals:
•       Less than 1,000sq. ft for the building footprint,
•       Setback no less than 58.6’ from Cobbs Cove /59.8’ from Thompson Lake as marked by a stake on each corner
•       Survey before concrete pour: Must include allowance for overhang of eaves approved by CEO prior to being poured.

Discussion: Pivoting of foundation: PB would like it rotated  approximately 5’ clockwise. Less impact on trees and less disturbance. Rick: If pivoted it will be closer than 59.8’. The dimension will be violated and not meet BOA requirements. CEO: Canopy can be opened up 40% in a ten year period. *Tabled until next meeting.

PB Requesting:
•       Retaining wall: Both sides of driveway to maintain any soil disturbance. Storm Water Management Plan.
•       Pivoting of foundation:  Applicant to provide “New” dimensions to show exactly how much it can be rotated.
•       Vertical elevation on the driveway side. How far down will it be going. The overall building height cannot be any higher from the lowest adjacent grade. (20’ right from the ridge line).
•       “Prior” to concrete being poured, applicant must prove to CEO that they do not violate setbacks.

A. Shoreland Zoning Ordinance: Page 29, section 15, Paragraph 3,
“In no event shall cleared openings for any purpose, including but not limited to, principal and accessory structures, driveways, lawns and sewage disposal areas, exceed in the aggregate, 25% of the lot area within the shoreland zone or ten thousand (10,000) square feet, whichever is greater, including land previously cleared. This provision shall not apply to the General Development Districts.”
*PB would like to workshop this and change verbiage for the words in italics. *Tabled until next meeting.
